Mark McAndrew and Evan Lyman Obtain Defense Verdict in Orange County Medical Malpractice/Wrongful Death Trial
Mark McAndrew and Evan Lyman obtained a swift defense verdict in Orange County Supreme Court on behalf of an emergency medicine attending physician in a wrongful death medical malpractice action after three weeks of trial. Plaintiff alleged that our physician client, during an 8 hour ED visit, failed to timely diagnose and treat venous & arterial thromboembolic disease, and similarly did not diagnose multiple and extensive PEs in a patient with Factor V Leiden, PFO & long Covid, and alleged a failure to anticoagulated the patient, which allegedly resulted in more extensive and severe pulmonary embolism, propagation of venous & arterial thrombosis and emboli & ultimately death.
While co-defendants settled during trial, our firm proceeded to verdict on behalf of the emergency medicine physician. We established that our client appropriately evaluated the patient during her time in the emergency department, pursued an appropriate differential diagnosis, and acted within the standard of care. The jury returned a defense verdict in about half an hour!
